However, recent decisions by the emulator’s creator, known as stenzek, regarding its distribution license have sparked significant unrest within the emulation community.

Originally, DuckStation was distributed under the General Public License (GPL), which is a widely used free software license that guarantees end users the freedom to use, study, share, and modify the software. However, at the beginning of the month, stenzek changed the license to a PolyForm Strict License and subsequently to the CC-BY-NC-ND license. These changes signify that the software now cannot be used for commercial purposes, and no derivatives or modifications are allowed. Moreover, these new licensing terms prevent the packaging of the emulator, which has been a common practice.

This licensing shift has not been well-received by many within the emulation community, mainly because DuckStation has been developed with contributions from numerous developers over the years. Despite this, stenzek has stated that he has received the approval of previous contributors for these changes. The modifications were prompted by instances of violation of the prior license involving non-attribution and unauthorized stripping of copyright by other parties, according to stenzek’s statement on GitHub.

In his detailed explanation, stenzek expressed frustration over how packagers did not clearly indicate their modifications and sometimes compromised the functionality of the software, an act contrary to the requirements of the original GPL. He also highlighted the lack of respect for copyright laws by some users and his reluctance to employ a Contributor License Agreement (CLA) that would strip contributors of their copyright.

Amid these changes, stenzek has faced threats, which he staunchly opposes, stating that those who are not copyright holders have no right to make demands. The situation has escalated to a point where stenzek openly discussed the possibility of shutting down the entire project if harassment continues. He emphasized that the ongoing drama surrounding the emulator’s licensing and the undue demands put on him in what should be a recreational activity are detracting from his main job and personal enjoyment.

The creator's ultimatum of potentially shutting down DuckStation has underscored the tension between maintaining an open, collaborative project while protecting one’s intellectual property and contributions.
